Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Vizzo AI ("we," "our," or "us"). By accessing or using Vizzo AI, you agree to be bound by these Terms. If you do not agree, do not use the service.

You must be at least 16 years of age to use Vizzo AI. By using the service, you represent and warrant that you are at least 16 years old.

2. Service Description

Vizzo AI is an AI-powered vision board generator. You provide written goals and prompts, and our service uses AI image generation to create personalized, print-ready vision boards delivered as high-quality PNG and A3 PDF files.

3. Account and Authentication

You must provide a valid email address to create an account. We use email-based one-time password (OTP) authentication. You are responsible for maintaining access to your email and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Pricing and Payments

Vizzo AI offers the following one-time purchase options:

Dream Starter — $3.99 (standard AI model, PNG + A3 PDF)
Daily Manifestor — $7.99 (enhanced AI model, premium templates and layouts)
Vision Master — $19.99 (premium AI model, exclusive features, priority support)

All payments are one-time, non-recurring charges processed securely through Stripe. Prices are listed in USD and are subject to change; any changes will not affect previously completed purchases.

5. Refund Policy

Due to the nature of AI-generated digital content, all purchases are final and non-refundable. If you experience a verifiable technical failure that prevents delivery of your purchased content (e.g., generation failure, corrupted files), contact us at vizzo.ai.board@gmail.com and we will work to resolve the issue or issue a refund at our sole discretion.

6. User Content and License

You retain ownership of the goals and text prompts you submit to Vizzo AI ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and transmit your User Content solely for the purpose of operating the service — including sending your goals and prompts to OpenAI for image generation and storing results in our systems.

You represent that you have the right to submit your User Content and that it does not violate any third-party rights or applicable laws.

7. AI-Generated Content

Vision boards are generated using artificial intelligence. You receive a personal-use license to your generated vision board images. Regarding AI-generated content:

AI-generated content may not be perfectly accurate or exactly match your expectations.
We make no guarantees regarding specific outcomes, results, or benefits from using vision boards.
Generated images are subject to OpenAI's usage policies and content restrictions.
We reserve the right to refuse generation of content that violates our acceptable use policy or OpenAI's policies.

8. Intellectual Property

The Vizzo AI name, logo, branding, website design, user interface, and underlying source code are owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or other proprietary materials beyond what is necessary to use the service as intended.

9. Acceptable Use

You agree not to:

Use the service to generate harmful, illegal, defamatory, obscene, or offensive content.
Attempt to reverse-engineer, decompile, or disassemble any part of the service.
Exploit vulnerabilities, circumvent security measures, or interfere with the operation of the service.
Share your account credentials or allow unauthorized access to your account.
Use automated tools, bots, or scrapers to access the service in a manner that exceeds normal usage.
Resell, redistribute, or commercially exploit generated content without authorization.
Use the service in any manner that violates applicable laws or regulations.

10. Disclaimer of Warranties

VIZZO AI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIZZO AI, ITS OWNERS, OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Vizzo AI, its owners, operators, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

13. Dispute Resolution

Informal Resolution: Before filing any formal proceeding, you agree to contact us at vizzo.ai.board@gmail.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any dispute arising out of or relating to these Terms or the service shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in class actions or class-wide arbitration.

14. Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms or engage in activity that harms the service or other users. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) shall survive.

You may request deletion of your account at any time by contacting us at vizzo.ai.board@gmail.com. Account deletion is subject to the data retention terms described in our Privacy Policy.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vizzo AI regarding the use of the service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the service.

18. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. To the extent litigation is permitted under these Terms, you consent to the jurisdiction of a court of competent jurisdiction.
